Terms & Conditions

1. Scope of Work

Toiling Builders Inc. (“we,” “us,” or “our”) agrees to perform remodeling, ADU, renovation, and accessibility upgrade services (“Services”) as outlined in the separate Service Agreement between Toiling Builders and the client (“Client”).

2. Scheduling & Project Timeline

All work will be completed according to the project schedule detailed in the Service Agreement. We commit to completing the work within the agreed timeframe, barring unforeseen events or permitting delays. Any changes shall be communicated promptly and documented.

3. Payment Terms

  • A deposit is due upon signing the Service Agreement as specified in that document.

  • Remaining payments follow the milestone schedule in the Agreement.

  • Late payments may incur interest at a rate of [e.g., 1.5% per month].

  • Final payment is due upon project completion and satisfaction confirmation.

4. Licensing & Insurance

Toiling Builders holds a valid California Class B General Building Contractor License (CSLB #1135477). We maintain full liability insurance and bonding to protect our Clients and their property throughout the project.

5. Permits & Compliance

Unless otherwise noted, obtaining all necessary permits is included in our Services. We ensure compliance with all applicable California building codes, ADA regulations (if required), and local zoning laws. Any changes required by permitting agencies will be addressed promptly.

6. Subcontractors

We may use qualified subcontractors. However, we remain responsible for the quality of their work and for coordinating all phases of the project effectively.

7. Warranty & Defects

We offer a [e.g., 1-year] warranty on workmanship from the date of completion. Cosmetic issues, non-structural defects, or minor adjustments will be resolved promptly. Damage caused by normal wear, misuse, or alterations not performed by us is not covered.

8. Change Orders

Any changes to the original scope must be approved in writing via Change Order, which may adjust the project cost and/or timeline.

9. Cancellation & Termination

  • If the Client cancels before work begins, the deposit may be refund-eligible per the Service Agreement terms.

  • Once work has commenced, cancellation charges may apply based on work completed and material costs. Termination for cause by either party must be communicated in writing with reasonable notice.

10. Dispute Resolution

If disputes arise, we’ll first seek resolution through mediation. If unresolved, disputes will proceed in Los Angeles County, California, under the jurisdiction of its courts.

11. Limitation of Liability

Toiling Builders shall not be liable for any indirect, incidental, or consequential damages arising from our Services. Our maximum liability is limited to the total amount paid by the Client for the specific project.

12. Governing Law

These Terms are governed by the laws of the State of California.
